1. Do I need a permit to hold a garage sale?

No permit is required to hold a garage sale. Garage sales may be held twice within any 90-day period. Each sale event is limited to three days. Garage sale signs may only be placed on the site where the sale is being held.

2. What can I do about the abandoned property next door?

Code Enforcement can have a vacant property mowed, any open doors or entryways boarded up, and most junk, trash, and debris removed within 10 days of notification. Report a Code Violation

1. Are there any permits required for working in the right of way?

Yes. Permits include a Right of Way Excavation Permit, city and state land disturbance permits, and others that depend on what work is being done. Contact the Engineering Division at (816) 331-4331 for more information about these permits.

2. Where is my property line in relation to the street?

If there is no curb, anything between the water meter and the street itself is usually the right of way(ROW). For streets with a 50-foot ROW, it is typically 11 feet behind the curb. If a curb exists for a 60-foot ROW, it would typically be 16 feet. Please contact Engineering at (816) 331-4331 before doing any work near the street.

3. What is an easement?

Property owner gives authorization for the use by another for a specified purpose such as water, sewer, and other utilities. A property owner still owns the easement, but if the property has a drainage or conservation easement is restricted as to fencing installation, etc. that might impead drainage flow.

4. What is a right-of-way?

A right-of-way area is owned by the public for the purposes of constructing, operating, and maintaining public facilities such as streets, alleys, sidewalks and bike paths in some cases, utilities, and other public infrastructures. Although it is public property and must not be landscaped or altered without City authorization, the maintenance is typically the responsibility of the adjacent property owner (i.e. mow, weed control, etc.).

1. How can I get a continuance or change my court date?

You may request one continuance 24 hours in advance of your court date by phone at (816) 331-2798 or at check-in. All other requests for continuance must be before the judge on your assigned court date. The judge cannot take telephone calls or see you outside of the courtroom. Continuances left on voicemail will not be granted.

3. Do I have to appear in court?

Only if your citation does not have a VIOLATION FINE amount pre-printed in the upper right hand portion of your citation.

4. Do I need an attorney?

You have the right to retain an attorney to represent you. You are not required to retain counsel; however, the court personnel, judge, and city prosecutor cannot dispense legal advice, advise you how to plead, or tell you what your sentence will be if you plead guilty.

5. Can I pay double the fine and have the points removed for my traffic violation?

No. You must retain private, legal counsel to amend any type of traffic violation. The city prosecutor will not enter into a plea agreement with you.

6. Is my fine due at the time I appear in court?

Yes, the Belton Municipal Court does not allow time to pay; extensions to pay or partial payments. Any fines assessed against you will be due in full at the time the Judge imposes sentence.

7. Will points be assessed for this ticket?

12. Can I plead No Contest?

Pleas of No Contest or Nolo Contendere are not allowed in Missouri courts.

13. Can I receive a Public Defender?

"Public Defenders" are referred to as Court Appointed Attorneys in Belton Municipal Court. They are not part of the Missouri Public Defenders office. If the City Prosecutor is requesting you be sentenced to a jail term for the violation for which you have been accused, the Judge will notify you before you enter a plea. If a jail term is possible as part of your sentence and you cannot afford an attorney, the court will appoint you an attorney. 14. Is there a dress code for appearing in court?

Yes, there is a strict dress code when appearing before the Judge. Shirt and shoes are required at all times. The following clothing is inappropriate and strictly prohibited: midriff baring shirts, shorts, skirts and pants, shorts and/or cutoffs of any sort, halter and tank tops, undershirts, bathing suits, hats, helmets, obscene/lewd printing of material on clothing.

15. Can I pay by phone or online?

No, we are not set up for payments by phone or website. We must swipe your card to process your payment. If you are using another's debit/credit card that person must be present upon payment.

16. How many points can I receive before I'm suspended/lose my license?

If you accumulate 8 points in 18 months, your driving privilege will be suspended for 30 days, if it is the first suspension; 60 days if it is the second suspension; and 90 days if it is the third suspension. If you accumulate 12 points in 12 months, 18 points in 24 months, or 24 points in 36 months, your driving privilege will be revoked for one year.

17. How many points are on my license?

The Municipal Court cannot tell how many points are on your license. You may contact the Missouri Department of Revenue at (573) 526-2407 to find out about non-personal information such as traffic tickets and suspension/revocation related information. 18. Can I attend driving school in lieu of paying a ticket or receiving points?

No, we do not accept driving school completions, on your own, in lieu of fines or points. You may request the Judge to assign a defensive driving school in lieu of points. However, please keep in mind that points will not be assessed against your license but the offense will appear on your driving record.

Driving records can be obtained from any of the Department of Revenue's licensed bureau offices. One is located at Main Street and Walnut Street in Belton. Others in the area are located in Grandview and Harrisonville.

3. How can I obtain a criminal background report on myself?

Call 816.331.5522 and ask for the property officer. She will set up a time for you to come to the police station and advise you what paperwork will be required to claim ownership. Pollution Control Division

1. What is a sewer service lateral and where does a customer's responsibility end regarding service laterals?

A sewer service lateral is the pipe that carries wastewater from a home or business to the sanitary sewer main line located in the street or other easement. Customers are responsible for their service lateral to and including the connection at the city main.

2. I smell sewer odor inside my home/building. What do I do?

*Check the caps on floor drains and cleanouts to ensure proper installation and fit.
*Check drains and make sure water is in the trap. If you cannot see any water, run a small amount into the drain.
*Check and make sure that the cleanout plugs have not been removed from the inside of the floor drains.
*Make sure there are no cracked or separated vent pipes in the interior of the structure that will allow sewer gas into your home/building.
*If odor problems continue after trying these suggestions, have your plumber check out the entire house system for any drain system air leaks.

3. Who do I call for a sewer backup or overflow?

For a sewer backup or overflow, please call (816) 331-7789. If no one is available to take your call, you will get a recording with detailed information. Please listen to the recording for further instructions.

4. Who is responsible for the sewage that backed up into my home?

The city does not make that determination. Our insurance company decides whether or not a claim will be paid. The Pollution Control Division investigates, troubleshoots, and resolves sewer-related issues in the public sector only.

5. Why are there flags in my yard?

It is generally because there is excavation work being planned in the area and the person, company or utility planning the work has requested "locates". The flags mark the location of buried utility lines. Before the City of Belton would do any major excavation work on your property you will be notified unless an emergency situation exists.

6. Why did you put that manhole in my yard?

When manholes are built, the tops are left exposed. Later, when homes and businesses are built, the manholes are occasionally buried in yards and driveways. The sewer maintenance staff uncovers these "lost" manholes and adjusts them to grade so they are accessible again. Having the manhole exposed will benefit the homeowner during a sewer emergency.

7. Can I landscape around the sewer manhole?

The Pollution Control Division recommends against placing any obstructions within a three foot radius of a manhole. This benefits the property owner and the city by providing faster access and avoiding damages to landscaping.

8. Why can't I connect my sump pump, area drain, stairwell drain, footing drains, etc. into the sanitary sewer?

The City of Belton and the Missouri Department of Natural Resources prohibits storm water discharges of any kind into the sanitary sewer system. This is to prevent overloading the sanitary sewer system with water that it wasn't designed to carry. When the system becomes overloaded it causes backups, and overflows and increases the amount of water that needs to be treated at the treatment plant. These illicit connections have a direct impact on your sewer rates.

They maintain the roadway, the signs, and the traffic signals along 58 Highway and at 71 Highway & 163rd Street. They are also responsible for mowing along 71 Highway.
